The Client must comply with the following requirements when applying for service in AEC: 

•A legal entity should be registered/recognised under the Acting Law of the AIFC when applying for a visa; 

•AIFC Bodies and Participants should apply for issuance/extension/renewal/cancellation/category change of Kazakhstan visas through AEC only;

•AIFC Participants should apply for establishing the Employment Allocation (The maximum permissible amount of work visas/registration issued to the employer to hire foreign citizens) before visa/registration processing for foreign employees; 

•Work visas/work registration are issued only within the established Employment Allocation; 

•AIFC Bodies and Participants must provide information on foreign employees to the AIFC Authority for keeping records under the Constitutional Statute of the Republic of Kazakhstan “On the Astana International Financial Centre”; 

•All required documents should be handed in as specified in this Guide; 

•All information provided on the applications submitted will be treated with confidentiality; 

•The information provided by the Client must be reliable and accurate to avoid any delays or errors. AEC will not be responsible for any errors on documents due to the provision of inaccurate information; 

•A valid foreign passport must have at least 2 blank pages for visas. The validity of the passport must not expire earlier than 3 months after the expiration date of the visa; 

•The Client must comply with the legislation of the Republic of Kazakhstan in the field of migration and the Acting Law of the AIFC;

•All the conditions and requirements specified in this Guide can be supplemented and changed under the legislation of the Republic of Kazakhstan, as well as the AIFC Acts, which govern the provision of AEC services;•All AEC services, including government and non-government, are subjected to the payment of the state fee, consular fees, and AEC service fees accordingly.

 

To hire foreign employees, the Employer (AIFC Participant) must observe the following CONDITIONS:

1. The AIFC Act on Employment Allocation.

Employment Allocation means the maximum permissible amount of work visas/registrations issued to the employer to hire foreign citizens, depending on the office space used according to the Office contract. 

Employment Allocation is established separately for each AIFC Participant, regarding the type of activity carried out by them, as well as the area of the office or production premises leased or owned. 

Employment Allocation is valid for one year only.

 

Documents to be submitted to AEC 

On a yearly basis or within 30 calendar days (If the information provided in the documents as mentioned below, is changed) the Employer submits to AEC with:

•Completed application; 

•Notarized copy of the lease, purchase and sale agreement or other document confirming the ownership of immovable property with a mandatory indication of the corporate details of the parties, the physical address, the total area of the premises and the lease term (in the case of a lease); 

•Clear copy of the certificate of registration of a legal entity (branch, representative offices) by the Acting Law of the AIFC. 

The processing time is 14 business days.

 

2. Keeping records of foreign employees hired by the AIFC Bodies and Participants.

Under the article 8 of the Constitutional Statute of the Republic of Kazakhstan “On the Astana International Financial Centre”, AIFC Authority must keep records of foreign labour hired by the AIFC Bodies and Participants.

Documents to be submitted to AEC:

To keep records the Employer and a foreign employee within 14 calendar days (after the arrival of the foreign employee to Kazakhstan as a holder of C3 work visa or work registration) provide AEC with: 

•Completed application form following (dowload link below);

•Clear copy of the passport of the foreign employee. 

The application is filled out by the foreign employee personally, or in printed form. 

When filling out in printed form, a foreign employee prints out the completed form and validates it with his handwritten signature. 

The Employer also validates the form with a handwritten signature of the authorized person, with an indication of the Employer’s name and by stamping the document with the company seal. 

In the event of a change in the data previously submitted, the foreign employee shall notify the AIFC Authority thereof in writing within 14 calendar days after such changes.
